ORDINANCE 2021-02             GOLF CART USE PERMIT APPLICATION

AN ORDINANCE TO PERMIT THE USE OF GOLF CARTS ON CITY STREETS UNDER AUTHORITY OF A.C.A. 14-54-1410 AND FOR OTHER PURPOSES.

WHEREAS, A.C.A. 14-54-1410 provides that it shall be within the municipal affairs and authority of any municipality in the State of Arkansas to authorize by ordinance any owner of a golf cart to operate the golf cart upon the city streets of the municipality with the exception of those city streets that are also designated as federal or state highway or county roads; and 

WHEREAS, the City Council deems it to be to the benefit of the citizens and residents of Gassville to have the opportunity of using and operating golf carts on the city streets in a reasonable and responsible manner; 

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GASSVILLE, ARKANSAS: 

Section 1. A person who is a licensed driver 16 (sixteen) years of age or older is authorized to use and operate a golf cart on the city streets of the City of Gassville, Arkansas, excluding those city streets that are also designated as federal or state highways or county roads, excluding as well the crossing of those highways, under the following terms and conditions: 

A. The golf cart must be in good working order and not present a hazard to the operator or other motorists or pedestrians because of defective mechanical conditions.
B. The operator of the golf cart must comply with all of the rules of the roadway when in motion as spelled out in Arkansas Law and in applicable Gassville City Ordinances.
C. The owner or operator of the golf cart must first obtain a permit from the City of Gassville to operate the golf cart on the city streets, which permit shall cost $25.00 (twenty-five dollars)(see attached Exhibit A) and be valid for a period of one (1) year from the date of issuance, and which valid permit (decal) must be affixed to the golf cart on the driver side windshield (lower left area). If the golf cart has no windshield, the permit (decal) shall be placed on the front (driver) side of the golf cart.
D. A golf cart may not be operated on any city sidewalks or on any city trails or walking areas within any city parks.

Section 2. Any person who operates a golf cart on the city streets of Gassville without having first obtained a valid permit from the City of Gassville or who operates a golf cart on city streets that is not in good mechanical condition and working order, or in a manner as otherwise prohibited hereby, shall be deemed guilty of a violation, and upon conviction thereof shall be assessed a fine not to exceed $100 (one-hundred dollars).
