ORDINANCE 2019-02

AN ORDINANCE TO BAN SMOKING AT CITY PARKS AND ALL CITY OWNED BUILDINGS AND GROUNDS WITHIN THE CITY OF GASSVILLE, ARKANSAS, DEFINING SMOKING PRODUCTS, PENALTIES AND ENFORCEMENT FOR VIOLATION, AND FOR OTHER PURPOSES.

WHEREAS: smoking has been proven to be detrimental to one's health and second hand smoke is undesirable and harmful also; and

WHEREAS: litter from smoking is unattractive and does not promote an environment of cleanliness in City parks, buildings or properties.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GASSVILLE, ARKANSAS:

SECTION 1. LOCATIONS.
Smoking shall be prohibited in the following locations: (1.) All City owned parks (including) ballfield, playground areas, pavilions, ball courts, restrooms, parking lots or any other area of parks not named. (2.) Af!.City owned buildings and grounds (including) City Hall, Community Center, Fire Department, Police Department, Public Works, Hwy 62 East property and all parking lots and property not named herein that is owned by the City of Gassville, Arkansas.

SECTION 2. DEFINITIONS.
The following defined products shall be prohibited from use within the ordinance:
(1.) Cigarettes: whether bought packaged or made with can or pouch tobacco individually.
(2.) Cigars: whether bought packaged or made with can or pouch tobacco individually.
(3.) Pipes: for the purpose of smoking tobacco.
(4.) E-Cigarettes: all electronic or battery form of (tobacco free) products that are used to inhale or vape.

SECTION 3. PENALTIES.
Any person found guilty of violating this ordinance in the District Court of the City of Gassville, Arkansas shall be guilty of a misdemeanor and a fine of not less than $25.00 twenty-five dollars nor more than $100.00 one -hundred dollars for the offense.
