ORDINANCE NO. 98-04
AN ORDINANCE PROHIBITING THE USE OF FIREWORKS WITHIN THE CITY LIMITS OF THE CITY OF GASSVILLE, ARKANSAS, EXCEPT DURING A DESIGNATED PERIOD OF TIME EACH YEAR. ALSO PROVIDING FOR A PENALTY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GASSVILLE, ARKANSAS THAT:
SECTION 1. Except during the period of June 25 through July 5, of each year, between the hours of 8:00 A.M. and 10:00 P.M., except on July 3 and 4 until 12:00 midnight, it shall be unlawful for any person, firm, or corporation to shoot, explode, discharge, fire, or set off any type of fireworks within the corporate limits of the City of Gassville, Arkansas. It shall also be unlawful to sell or manufacture any type of fireworks or operate an establishment of any kind for the purpose of selling or manufacturing fireworks within the city limits of the City of Gassville, Arkansas.
SECTION 2. Fireworks may only be used on your own property unless written permission is obtained from the property owner on whose property the fireworks are being used. The person, firm, or corporation using the fireworks shall be responsible for any part or parts of any fireworks that fall or falls on any property other than their own, or on any property that you have written permission to use for fireworks.
SECTION 3. Absolutely no fireworks of any kind are to be used on any property that belongs to the City of Gassville, Arkansas, without first obtaining a permit from the Gassville City Council.
SECTION 4. Application for a fireworks permit must be made in writing to the Gassville City Council setting forth the place, date, time and purpose for the use of the fireworks. If the Gassville City Council approves the request for a Fireworks Permit, the Fireworks Permit will be issued at the Gassville City Hall during normal business hours. Normal business hours are from 8:00 A.M. to 4:30 P.M., Monday through Friday, except holidays.
SECTION 5. Any person, firm, or corporation convicted of violating the provisions of this ordinance shall be deemed guilty of a misdemeanor, and shall be fined a sum of not less than fifty dollars ($50) nor more than two hundred dollars ($200) for each and every violation.
SECTION 6. Any ordinance or parts of ordinances in conflict herewith of this ordinance, are hereby repealed.
SECTION 7. Whereas this ordinance is necessary for the preservation of the health and safety of the citizens of Gassville, Arkansas, an emergency is hereby declared to exist, and this ordinance shall be in full force and effect after its passage.
